Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the KidsGPT mobile application (the "App") operated by KidsGPT ("us", "we", or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

Use of the App

KidsGPT is an educational application designed for children with parental supervision. By using our App, you agree to:

• Use the App in accordance with these Terms and applicable laws and regulations;
• Ensure appropriate parental supervision when children are using the App;
• Not use the App for any illegal or unauthorized purpose;
• Not attempt to interfere with or compromise the system integrity or security of the App;
• Not distribute viruses or any other harmful computer code through the App.

Children's Use and COPPA Compliance

Our App is designed for use by children aged 5-13 with parental supervision. We comply with the Children's Online Privacy Protection Act (COPPA) and Google's Family Policy requirements for apps directed to children. By allowing your child to use the App, you agree that:

• You will provide verifiable parental consent before we collect any personal information from children under 13;
• You will supervise your child's use of the App;
• You understand and consent to the data collection practices described in our Privacy Policy;
• You acknowledge that the App contains age-appropriate content and features designed for children;
• You have the right to review, delete, and refuse further collection of your child's personal information.

Subscriptions

Some parts of the App are available on a subscription basis. You will be billed in advance on a recurring basis, depending on the subscription plan you select.

You can cancel your subscription at any time through your app store account settings. Your cancellation will take effect at the end of the current billing period.

For subscriptions purchased through Google Play or the App Store, the respective store's terms regarding subscriptions, billing, and cancellations apply.

Content and AI Interactions

Our App allows users to interact with AI-generated content through text and voice inputs. While we strive to ensure that all content is appropriate for children, we cannot guarantee that all AI-generated content will be completely free from errors or inappropriate material. Parents and guardians should supervise children's use of the App.

When using voice features, audio data is processed by third-party AI services as described in our Privacy Policy. By using these features, you consent to the processing of audio data in accordance with our Privacy Policy.

Google Services

Our App uses various Google services, including Firebase Analytics, Firebase Authentication, and Google Sign-In. By using our App, you agree to:

• The collection and use of information as described in our Privacy Policy;
• Google's Terms of Service and Privacy Policy as they relate to these services;
• The use of Google services in a manner compliant with COPPA and applicable children's privacy laws.

Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of KidsGPT and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Parental Controls and Monitoring

Our App provides parental controls to help parents monitor and manage their child's usage. These features include:

• PIN-protected parent dashboard
• Usage time limits and scheduling
• Content filtering options
• Chat history review
• Topic management

Parents are encouraged to use these features to ensure their child's experience is safe and appropriate.

Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

In no event shall KidsGPT, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
